Charges of sexual misconduct against local attorney Beryn Duncanson have been dismissed.

Duncanson, who is the son of the publisher and editor of the TCI Weekly News, Blythe Duncanson, was arrested and charged in June of last year with sexual assault of a woman at a party.

Duncanson denied any misconduct and was released on bail of $10,000.

However, the case was dismissed last week, when a video tape said to be in the possession of prosecution was not made available to the defence. Court observers believe the tape would have cleared Duncanson and apparently so did the judge, who decided the withholding of the evidence was prejudicial to Duncanson’s case.
